Who we are

NotiSpark Mail and notispark.com are run by NotiSpark, Massachusetts, USA (“we”). You can reach us through our contact form.

Your account

Keep your password safe and your details up to date. You are responsible for what happens under your account. You must be at least 13 years old, or older where the law where you live requires it (up to 16 in some EU countries), and old enough to agree to these terms, or have a parent or guardian agree for you.

Free trial

New accounts can try the paid features free for 30 days (the pricing page shows the current length), without entering payment details. There is one trial per person and device. When the trial ends, the account moves to the Free plan unless you choose a paid plan.

Plans and payment

• The free plan is free for as long as we offer it.
• Paid plans renew automatically each month or year until you cancel. You can cancel at any time from your account page; your plan stays active until the end of the period you paid for, then your account moves to the Free plan.
• Payments are handled by our payment company, Paddle or Stripe. Paddle sells to you as the merchant of record and adds the taxes required where you live; its own buyer terms also apply to the purchase.
• If a payment is refunded or reversed (for example a chargeback), what it paid for ends.

Prices and sales

• You pay the price shown at checkout. Sale prices and launch offers apply only to purchases made while they run, and only to the payment they name (for example the first year).
• A price change never changes what you already paid. For subscriptions, a new price applies only from a later renewal, and we tell you at least 30 days before.
• A sale that starts after you bought does not give you back the difference.

One-time license and “Every future version”

Pro is also sold as a one-time license:

• You pay once and keep Pro, with every update of the major version you bought (for example every 1.x version), on the number of computers your plan allows, for as long as you like.
• A new major version (for example 2.0) is an optional upgrade at the upgrade price shown on the pricing page. If you bought in the year before the new version comes out, the upgrade is free.
• If you don’t upgrade, your version keeps working with the phone apps and NotiSpark Sync for at least 2 years after the next major version comes out, and gets important and security fixes for 1 year. After that it keeps working, just without fixes.
• “Every future version”, bought with the license or added later, includes every future major version: you never pay for an upgrade again.
• The phone apps are always included, whatever their version.

Refunds

Pro and Business start with a 30-day free trial, with no card needed, so you can try everything before you pay. That is why:

• Pro and Business plans and one-time licenses are not refunded, except for an accidental duplicate purchase, or a technical problem on our side that we can’t fix. Contact us and we’ll sort it out.
• Subscriptions can be canceled at any time and run until the end of the period you paid for. The rest of that period is not refunded.
• Store animations play as soon as you buy them, so they are normally not refunded. If one doesn’t play on your device, we fix it or refund it. A refund removes the animation from your devices, because each copy is made for its buyer.
• NotiSpark AI credit packs are refunded within 14 days of purchase if you haven’t used any credits from that pack. Credits you have used are not refunded. Monthly credits and the welcome gift are free, so there is nothing to refund.
• None of this limits your rights under the law, for example when something you bought doesn’t work as described.

Right of withdrawal (EU and UK)

If you live in the EU or the UK, you normally have 14 days to withdraw from an online purchase. Licenses, plans, store animations and NotiSpark AI credit packs are digital content that you get right away. Before you pay, the checkout asks you to confirm that you want access at once and that you then lose this right of withdrawal. You can’t buy without confirming it. Your other legal rights, and the refunds above, still apply.

Business plans and teams

Business is priced per person. The account owner pays for a number of seats and can invite people by email; each person who joins uses one seat, keeps their own NotiSpark account and gets the Business features while they are in the team. If the owner removes someone, lowers the number of seats or the plan ends, those people lose the Business features. The owner cannot read the members’ email or settings.

Store animations

Animations bought in the store are a one-time payment for a personal license to use them, not a sale of the animation itself. Your copy is locked to your NotiSpark account and plays on your own devices, on every plan (Free too), for as long as your account exists. You may not copy, share, resell or extract them. If a payment is refunded or reversed, the animation is removed again.

Beta features

Some parts of NotiSpark Mail are in beta, including the Android app for now. Beta features are still being tested: they may have bugs, and they may change or be removed. Keep your own copies of anything important.

AI help

AI features suggest text, summaries, sorting and answers. AI can be wrong or miss things, so check what it writes before you send it or rely on it. You decide what to send. If you connect your own AI account, that service’s own terms and prices apply.

NotiSpark AI and credits

NotiSpark AI is our optional online AI. Each action uses credits, as shown in the app and in your account.

• Credits are prepaid: they come with your plan or you buy them before you use them. You are never billed afterwards for AI use.
• Credits are not money. They have no cash value, can’t be sold or exchanged, and can’t be moved to another account. A Business team owner can share the team’s monthly credits as one pool.
• Monthly credits come with Pro and Business and renew with your plan. Unused monthly credits don’t carry over, and they end when the plan ends. They are used before bought credits.
• Bought credits and the welcome gift never expire while your account exists. They end when you delete your account.
• Trial credits are for trying NotiSpark AI during the free trial, once per person, and end with the trial.
• To keep it fair and running for everyone, there are limits per minute and per day, a longest text for each action and a daily maximum for automatic use. NotiSpark AI may also pause now and then, for example for maintenance or when many people are using trial credits. Your credits stay safe.
• We choose the AI companies and models and may change them to keep the quality and the price right. How many credits an action uses is shown in the app and may change; this never changes the credits you already have.
• If a credit pack payment is refunded or reversed, the pack’s unused credits are removed. If some were already used, NotiSpark AI pauses until new credits pay them back.
• Like any AI, NotiSpark AI can be wrong. Check its answers before you rely on them, and don’t use it to break the law or these terms.

Your content

Designs, pictures and signatures you save to your account stay yours. You allow us to store, process and show them only to provide the service to you. Only save content you have the right to use.

Devices

Each plan includes a number of computers and phones. You can remove devices from your account page to make room for new ones.

Fair use

Do not use NotiSpark to send spam or unlawful content, to harass anyone, or to break the law. Do not try to break, overload or reverse-engineer the service. We may suspend accounts that do.

Advanced Read Receipts (email open tracking)

Read receipts tell you when an email you sent was opened. Results depend on the recipient’s mail app and may not be complete. You are responsible for using it lawfully, including telling recipients where the law requires it. See our privacy policy.

Your email

Your email and data stay yours. The apps work with your email provider’s service, which has its own terms.

Parts made by others

NotiSpark Mail includes software and AI models made by others, such as open-source components and the optional NVIDIA speed-up pack. They come with their own licenses, which apply to those parts.

Changes to NotiSpark and to these terms

We keep improving NotiSpark and may add, change or remove features. We aim for the service to be available at all times but cannot promise it will never be interrupted.

If we make an important change to these terms, we will tell you by email at least 30 days before it applies. The date of the last change is shown at the top of this page.

Liability

NotiSpark is provided “as is”. To the extent the law allows, we are not liable for indirect losses, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer law.

Ending

You can stop using NotiSpark and delete your account at any time. We may end these terms if you seriously break them.

Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, USA, and disputes go to the courts there. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and can also go to the courts there. For example, customers in the EU and the UK keep all their consumer rights.
